Speaker Gbabin Ordered Back to the Supreme Court its Court Processes

It’s past a week when many Ghanaians breathed a great sigh of relief following the unprecedented brief tension and uncertainty that engulfed the country in an already charged political period over the controversial vacant seat in parliament and the Nation’s apex court ruling against the legislative body.

A letter now circulating in the public domain, dated October 18, showed Speaker Gbabin’s rejection of efforts by bailiffs of the Supreme Court to serve processes with respect to the writ filed on his ruling that declared four seats vacant.

It appears the showdown between the speaker of parliament’s ruling and that of the supreme court against it is about to properly begin.

In the said letter, the Speaker cited the immunity that his office enjoys under Article 117 of the 1992 Constitution to reject the document and have it returned to the Supreme Court.

“The attached processes which were left at the Legal Services Office of the Parliamentary Service by three bailiffs of the Court on Wednesday, 16th October 2024, are hereby returned.” Stated in the return letter to the apex court.

The letter also sought to remind the supreme court of its limitation and jurisdiction   in meddling in the affairs of parliament as an independent arm of government.  

Lawyers of Mr. Alban Gbagbin have filed a case in the Supreme Court, asking it to rescind its ruling against the decision of the Speaker to declare the 4 MPs’ seats vacant.  

However, many are wondering if the Supreme Court will be willing to eat humble pie to reverse its own decision.

The case is set to be heard tomorrow, October 30. All eyes will be on this matter and its outcome as whatever that may transpire has the potential to heighten or cooldown the disturbing and dangerous political tension in the country.
